Subject: Leona Quarry violations 11/11/04

Jun

This morning I observed the baker tanks as well as the small detention pond near the baker tanks discharging dirty water into City storm drains. In addition dirty water from surface run off from the site was entering City storm drains. I also understand that dirty water coming off the site on the north western side of the development was entering city storm drains.

My understanding is that these are violations of City and State permits for this project.

It is also my understanding that the City has so far failed to fine the developer for any of the any of the many events that you have determined to be violations.

I believe that the City is legally responsible to see that the developer
conform to building regulations as well as local, state and federal law.
I believe that the City has been negligent in these responsibilities.

I have appreciated your responsiveness in the past and hope that in the
future the City will respond to your findings.
